AIPartner OÜ, together with its subsidiaries and affiliates (“AIPartner,” “the Company,” “we,” “us,” or “our”), is committed to protecting the privacy of individuals who access, use, or register for our Services (as defined below).

This Privacy Policy (the “Policy”) explains how we collect, use, disclose, and otherwise process Personal Data when you interact with our Services, and how you may exercise your rights under applicable data protection and privacy laws.

Please read this Policy carefully to understand how we handle your Personal Data and make sure to take into account the Data Privacy Agreement (“DPA”) where applicable. In case of any contradiction, the DPA shall prevail over this Privacy Policy.

Our Services may contain links to third-party websites. We are not responsible for the privacy practices of such third parties, and we encourage you to review their privacy policies before providing them with any information.

1. Our Services. AIPartner operates an online platform (the “Platform”) that helps businesses and individuals (“Customers,” “Users,” or “you”) identify and connect with independent third-party cloud partners (each, a “Partner”) authorized to resell, provision, provide consulting or support services on public cloud infrastructure platforms and LLM platforms, including notably Google Cloud Platform (“GCP”), Amazon Web Services (“AWS”), Microsoft Azure (“Azure”) and Anthropic or OpenAI LLM platforms (collectively, the “Platforms”). Through the Platform, AIPartner collects information about a Customer’s cloud usage, needs, and objectives in order to match the Customer with one or more Partners best suited to provide cloud resale, migration, cost optimization, or support services. AIPartner also operates the website located at www.aipartner.cloud (the “Website”). For purposes of this Policy, the Platform, the Website, and any related communications, webinars, or chatbots are collectively referred to as the “Services.”

This Policy applies to Personal Data relating to an identified or identifiable individual (“Personal Data”) that we collect when you access or interact with our Services, in instances where AIPartner acts as controller of such Personal Data.

This Policy does not apply to: (i) data that a Partners collect, use, or otherwise process independently once a match has been made, which is governed by that Partner’s own privacy notice; (ii) products, services, websites, or content offered by third parties, including the Platforms themselves, which maintain their own privacy notices; or (iii) Personal Data of AIPartner’s employees, which is governed by a separate internal policy.

2. Personal Data We Collect About You. When you interact with our Services — for example, by submitting a matching request, creating an account, completing a form on our Website, or contacting us for support — we collect the following categories of Personal Data.

(a) Identification Data. Your full name and email address, provided when you register for or use the Services.

(b) Technical Data. Your IP address and related device and browser information, collected automatically when you access the Services.

(c) Cloud Usage Data. Information regarding your average cloud consumption or spend across the Platforms.

(d) Project Data. Details of your specific project needs, which may include your cloud spend, planned migration timelines, and the support services you are seeking from a Partner.

(e) Consent Records. Your acceptance of AIPartner’s Terms and Conditions (“T&Cs”) and of this Policy.

(f) Information from Third Parties. Personal Data provided by our partners, publicly available sources, and other trusted third-party sources, such as advertising partners.

3. How We Use Your Personal Data. We use your Personal Data for the following purposes: (a) to provide, maintain, and improve the Services; (b) to match you with one or more suitable Partners and facilitate your introduction to them; (c) to respond to support requests; (d) to manage your account; (e) to send marketing communications, where permitted; (f) to prevent fraud and maintain security; (g) to comply with applicable law; and (h) for other legitimate business purposes permitted by applicable law.

4. Recipients of Personal Data. We may share Personal Data with the following categories of recipients. Our current Sub-processors are listed at aipartner.cloud/sub-processors, and the DPA is published at aipartner.cloud/data-processing-agreement.

(a) Cloud Reseller Partners. When you submit a matching request, we disclose your Identification Data, Cloud Usage Data, and Project Data to the Reseller Partner(s) selected to respond to your request, so that they may contact you directly and provide a quote or proposal. All the specific details are within the DPA that both parties will sign to execute the Contract.

(b) Platforms. Where necessary to facilitate Partner’s services, limited Personal Data may be shared, notably with Cloud providers such as GCP, AWS, Azure, or with the LLM provider that powers the Platform's AI features, currently Groq, Inc.

(c) Service Providers. Vendors that support our analytics, hosting, and customer support functions.

(d) Advertising Partners. For marketing and analytics purposes.

(e) Payment Processors. To process any payments made through the Services.

(f) Authorities and Regulators. Where required to comply with applicable law.

AIPartner requires appropriate contractual safeguards with all Partners and other third parties that receive Personal Data. We may also share Personal Data in connection with a merger, acquisition, reorganization, bankruptcy, or the sale of all or part of our assets. Any party that acquires our assets in such a transaction may continue to use your data in accordance with the terms of this Policy.

5. International Data Transfers. To operate our business globally, the Personal Data we collect may be stored, processed, or transferred outside of your jurisdiction, including to the United States and to the jurisdictions in which our Partners are located. Where required, we rely on appropriate safeguards, including: European Commission adequacy decisions; Standard Contractual Clauses; the UK International Data Transfer Addendum; and the EU-U.S., UK-U.S., and Swiss-U.S. Data Privacy Frameworks (“DPF”). 6. Data Retention. We retain Personal Data only for as long as necessary for the legitimate business purposes for which it was collected, to comply with our legal obligations, resolve disputes, and enforce our agreements. In determining retention periods, we consider the type and sensitivity of the information collected, the purpose of its collection, the risk of unauthorized disclosure, and applicable legal requirements.

7. Data Security. We implement physical, technical, and administrative measures designed to protect your information against unauthorized disclosure, access, or use, and we require our vendors and Partners to contractually commit to maintaining an equivalent level of protection.

8. Cookies and Tracking Technologies. We use cookies and similar technologies to operate and improve our Services . These may include: (a) strictly necessary cookies, required for you to navigate and use the features of our Services; (b) functional cookies, which enable enhanced functionality and personalization; (c) analytics cookies, which collect information about your activity on our Services in the aggregate to help us improve performance; and (d) advertising cookies, which may be placed by our advertising partners to make advertising more relevant. You may manage your preferences through our cookie settings tool, your browser settings, a Do-Not-Track signal, or a browser extension such as Disconnect or Ghostery. 9. EU, UK, and Swiss Residents. This Section addresses rights specific to residents of the EU, the UK, Switzerland, or residents of other jurisdictions granting equivalent rights. You have the right to: access your Personal Data; rectify inaccurate data; request erasure (“right to be forgotten”); restrict processing; request data portability; object to processing; withdraw your consent at any time; and lodge a complaint with a supervisory authority. These rights are not absolute and may be limited by our own legitimate interests and applicable regulatory requirements. To exercise your rights, please write to: legal@aipartner.cloud

10. California Residents. This Section addresses specific disclosure requirements under the California Consumer Privacy Act of 2018 (Cal. Civ. §§ 1798.100–1798.199) and its implementing regulations (collectively, the “CCPA”).

(a) Rights under the CCPA. You have the right to know the categories and specific pieces of Personal Data we have collected about you, the categories of sources from which it was collected, the business or commercial purpose for collecting it, the categories of Personal Data we have disclosed for a business purpose, the categories of Personal Data we have sold or shared, if any, and the categories of third parties with whom your Personal Data has been shared. You also have the right to request deletion, the right to correct inaccurate information, the right to opt out of the sale or sharing of your Personal Data, and the right to non-discrimination for exercising your CCPA rights.

(b) Sale or Sharing of Personal Information. AIPartner does not “sell” Personal Data for monetary consideration. We disclose Personal Data only to the categories of recipients listed in Section 4 of this Policy — Partners, Platforms, service providers, advertising partners, payment processors, and authorities or regulators where required by law — and only for the purposes described herein and within the course of providing the Services.

(c) Exercising Your Rights. You may exercise your rights by submitting a verifiable consumer request to legal@aipartner.cloud Only you, or someone legally authorized to act on your behalf, may make such a request. We aim to respond within 30– to 45 days and may need to verify your identity before doing so.

11. Canada Residents. As a Canadian resident, under the Personal Information Protection and Electronic Documents Act (“PIPEDA”), you have the right to request access to, and rectification of, your Personal Data, and to withdraw your consent to its use at any time. You may submit such requests to legal@aipartner.cloud. We aim to respond within 30 days. You have the right to file a complaint with the Office of the Privacy Commissioner of Canada if you are not satisfied with the outcome of your request.

12. Israel Residents. You are under no legal obligation to provide us with Personal Data, and you do so voluntarily and with your consent. We may transfer your Personal Data to third parties who may reside outside the State of Israel, where the level of data protection may differ; in such cases, we implement contractual measures to ensure that recipients provide appropriate safeguards in accordance with applicable law. You may request access to, rectification of, or deletion of your Personal Data used for direct marketing purposes, as defined under applicable local privacy law.

13. Minors. We do not knowingly collect or solicit Personal Data from any person who has not reached the age of majority (as determined by the laws applicable to that person’s place of residence; a “Minor”) . By accessing, using, or interacting with our Services, you represent that you are not a Minor. If we learn that we have collected Personal Data from a Minor without verified parental consent, we will delete such information promptly upon discovery. If you believe we may hold information from or about a Minor, please contact us using the details below.

14. Updates to this Policy. We reserve the right to modify this Policy at any time. The most recent version will always be posted on our Services (as indicated by the “Last updated” date). We encourage you to review this Policy periodically. By continuing to access or use our Services after a revision takes effect, you agree to be bound by the updated Policy.
